<p class="article_blog_text"><img class="alignleft size-full wp-image-7624" style="border-style: none; padding: 0px; margin-right: 8px; margin-bottom: 8px; position: relative;" title="Neal Gilbert" src="http://www.avadtechnologies.com/wp-content/uploads/2009/11/neal_title.png" alt="Neal Gilbert" width="100" height="128" />I came across a great article on <a href="http://broadbandignite.com/2009/11/18/net-neutrality-does-not-have-to-be-a-zero-sum-game/" target="_blank">Broadsoft's blog</a> about Net Neutrality.  There is a huge power struggle going on between the companies that provide internet service and companies that provide services that require the internet.</p>
<p class="article_blog_text"><strong>Voice over IP (VoIP)</strong> is just one of the thousands of services that require an internet connection.</p>
<p class="article_blog_text">One of the biggest issues being contested is the ability of <strong>internet service providers</strong> to favor their own content or limit access to content based on type.  For example, Comcast, one of the leading internet service providers also provides internet phone service or VoIP, without a truely nuetral internet, Comcast would be able to block other VoIP Providers such as Vonage.</p>
<p class="article_blog_text">Allowing internet service providers to limit consumers access to certain types of content, or favor their own brands would have a chilling effect on our entire economy.</p>

			<content:encoded><![CDATA[<p class="article_blog_text">When VoIP provider SunRocket unexpectedly closed its doors in 2007, many customers were not aware of the closure until they picked up the phone and did not hear a dial tone.</p>
<p class="article_blog_text">In an effort to prevent a similar situation, the Federal Communications Commission on Wednesday approved a rule that would require failing VoIP providers to give reasonable notice to customers and regulatory officials before they shut down.</p>
<p class="article_blog_text"><span id="more-3974"></span></p>
<p class="article_blog_text">The commission also approved a rule requiring phone providers to provide number portability within one business day instead of four.</p>
<p class="article_blog_text">The FCC did not specify how far in advance a VoIP provider would have to provide this notification except to say that it should be done in a reasonable amount of time.</p>
<p class="article_blog_text">"These requirements do not strike me as burdensome," acting Chairman Michael Copps said during the commission's monthly open meeting.</p>
<p class="article_blog_text">"More people will switch to VoIP as we push broadband around the country" so it's imperative that the system is secure, said Democratic Commissioner Jonathan Adelstein.</p>
<p class="article_blog_text">It is also a serious public safety matter, he said, if a user needs to dial 911 and finds themselves unexpectedly without service.</p>
<p class="article_blog_text">Republican Commissioner Robert McDowell, who subscribed to a VoIP provider that suddenly closed up shop three years ago, said the new rule "gives consumers a reasonable opportunity to switch providers."</p>
<p class="article_blog_text">The commissioners also approved a rule requiring landline, wireless, and certain VoIP providers to switch customers' phone numbers to another provider within one business day rather than the current four day requirement.</p>
<p class="article_blog_text">The rule will now be handed over to the North American Numbering Council (NANC), a federal advisory committee that advises the FCC on numbering issues, which will provide its input on the rule within 90 days.</p>
<p class="article_blog_text">After the NANC report is received, carriers will have nine months to comply. Smaller carriers will have 15 months.</p>
<p class="article_blog_text">"While the wireless industry has adopted a standard 2.5 hour porting interval for wireless-to-wireless ports voluntarily, thereby avoiding most opportunity for mischief, there has been no such industry-wide voluntary interval for wireline-to-wireline and intermodal ports," Copps said. "Thus, the Commission was compelled to implement a mandatory interval so that consumers of all voice services can realize the true benefits intended by local number portability."</p>

An Act

To promote and enhance public safety by facilitating the rapid deployment of IP-enabled 911 and E-911 services, encourage the Nation's transition to a national IP-enabled emergency network, and improve 911 and E-911 access to those with disabilities.
<ul><em>Be it enacted by the Senate and House of Representatives of the United States of America in Congress assembled</em>,</ul>
<span id="more-712"></span>
<h3>SECTION 1. SHORT TITLE.</h3>
<ul> This Act may be cited as the `New and Emerging Technologies 911 Improvement Act of 2008' or the `NET 911 Improvement Act of 2008'.</ul>
<h4>TITLE I--911 SERVICES AND IP-ENABLED VOICE SERVICE PROVIDERS</h4>
<h3>SEC. 101. DUTY TO PROVIDE 911 AND ENHANCED 911 SERVICE.</h3>
<ul> The Wireless Communications and Public Safety Act of 1999 is amended--</ul>
<ul>
	<li>
<ul> (1) by redesignating section 6 (47 U.S.C. 615b) as section 7;</ul>
</li>
</ul>
<ul>
	<li>
<ul> (2) by inserting after section 5 the following new section:</ul>
</li>
</ul>
<h3>`SEC. 6. DUTY TO PROVIDE 9-1-1 AND ENHANCED 9-1-1 SERVICE.</h3>
<ul> `(a) Duties- It shall be the duty of each IP-enabled voice service provider to provide 9-1-1 service and enhanced 9-1-1 service to its subscribers in accordance with the requirements of the Federal Communications Commission, as in effect on the date of enactment of the New and Emerging Technologies 911 Improvement Act of 2008 and as such requirements may be modified by the Commission from time to time.</ul>
<ul> `(b) Parity for IP-Enabled Voice Service Providers- An IP-enabled voice service provider that seeks capabilities to provide 9-1-1 and enhanced 9-1-1 service from an entity with ownership or control over such capabilities, to comply with its obligations under subsection (a), shall, for the exclusive purpose of complying with such obligations, have a right of access to such capabilities, including interconnection, to provide 9-1-1 and enhanced 9-1-1 service on the same rates, terms, and conditions that are provided to a provider of commercial mobile service (as such term is defined in section 332(d) of the Communications Act of 1934 (47 U.S.C. 332(d))), subject to such regulations as the Commission prescribes under subsection (c).</ul>
<ul> `(c) Regulations- The Commission--</ul>
<ul>
	<li>
<ul> `(1) within 90 days after the date of enactment of the New and Emerging Technologies 911 Improvement Act of 2008, shall issue regulations implementing such Act, including regulations that--</ul>
</li>
</ul>
<ul>
	<li>
<ul>
	<li>
<ul> `(A) ensure that IP-enabled voice service providers have the ability to exercise their rights under subsection (b);</ul>
</li>
</ul>
</li>
</ul>
<ul>
	<li>
<ul>
	<li>
<ul> `(B) take into account any technical, network security, or information privacy requirements that are specific to IP-enabled voice services; and</ul>
</li>
</ul>
</li>
</ul>
<ul>
	<li>
<ul>
	<li>
<ul> `(C) provide, with respect to any capabilities that are not required to be made available to a commercial mobile service provider but that the Commission determines under subparagraph (B) of this paragraph or paragraph (2) are necessary for an IP-enabled voice service provider to comply with its obligations under subsection (a), that such capabilities shall be available at the same rates, terms, and conditions as would apply if such capabilities were made available to a commercial mobile service provider;</ul>
</li>
</ul>
</li>
</ul>
<ul>
	<li>
<ul> `(2) shall require IP-enabled voice service providers to which the regulations apply to register with the Commission and to establish a point of contact for public safety and government officials relative to 9-1-1 and enhanced 9-1-1 service and access; and</ul>
</li>
</ul>
<ul>
	<li>
<ul> `(3) may modify such regulations from time to time, as necessitated by changes in the market or technology, to ensure the ability of an IP-enabled voice service provider to comply with its obligations under subsection (a) and to exercise its rights under subsection (b).</ul>
</li>
</ul>
<ul> `(d) Delegation of Enforcement to State Commissions- The Commission may delegate authority to enforce the regulations issued under subsection (c) to State commissions or other State or local agencies or programs with jurisdiction over emergency communications. Nothing in this section is intended to alter the authority of State commissions or other State or local agencies with jurisdiction over emergency communications, provided that the exercise of such authority is not inconsistent with Federal law or Commission requirements.</ul>
<ul> `(e) Implementation-</ul>
<ul>
	<li>
<ul> `(1) LIMITATION- Nothing in this section shall be construed to permit the Commission to issue regulations that require or impose a specific technology or technological standard.</ul>
</li>
</ul>
<ul>
	<li>
<ul> `(2) ENFORCEMENT- The Commission shall enforce this section as if this section was a part of the Communications Act of 1934. For purposes of this section, any violations of this section, or any regulations promulgated under this section, shall be considered to be a violation of the Communications Act of 1934 or a regulation promulgated under that Act, respectively.</ul>
</li>
</ul>
<ul> `(f) State Authority Over Fees-</ul>
<ul>
	<li>
<ul> `(1) AUTHORITY- Nothing in this Act, the Communications Act of 1934 (47 U.S.C. 151 et seq.), the New and Emerging Technologies 911 Improvement Act of 2008, or any Commission regulation or order shall prevent the imposition and collection of a fee or charge applicable to commercial mobile services or IP-enabled voice services specifically designated by a State, political subdivision thereof, Indian tribe, or village or regional corporation serving a region established pursuant to the Alaska Native Claims Settlement Act, as amended (85 Stat. 688) for the support or implementation of 9-1-1 or enhanced 9-1-1 services, provided that the fee or charge is obligated or expended only in support of 9-1-1 and enhanced 9-1-1 services, or enhancements of such services, as specified in the provision of State or local law adopting the fee or charge. For each class of subscribers to IP-enabled voice services, the fee or charge may not exceed the amount of any such fee or charge applicable to the same class of subscribers to telecommunications services.</ul>
</li>
</ul>
<ul>
	<li>
<ul> `(2) FEE ACCOUNTABILITY REPORT- To ensure efficiency, transparency, and accountability in the collection and expenditure of a fee or charge for the support or implementation of 9-1-1 or enhanced 9-1-1 services, the Commission shall submit a report within 1 year after the date of enactment of the New and Emerging Technologies 911 Improvement Act of 2008, and annually thereafter, to the Committee on Commerce, Science and Transportation of the Senate and the Committee on Energy and Commerce of the House of Representatives detailing the status in each State of the collection and distribution of such fees or charges, and including findings on the amount of revenues obligated or expended by each State or political subdivision thereof for any purpose other than the purpose for which any such fees or charges are specified.</ul>
</li>
</ul>
<ul> `(g) Availability of PSAP Information- The Commission may compile a list of public safety answering point contact information, contact information for providers of selective routers, testing procedures, classes and types of services supported by public safety answering points, and other information concerning 9-1-1 and enhanced 9-1-1 elements, for the purpose of assisting IP-enabled voice service providers in complying with this section, and may make any portion of such information available to telecommunications carriers, wireless carriers, IP-enabled voice service providers, other emergency service providers, or the vendors to or agents of any such carriers or providers, if such availability would improve public safety.</ul>
<ul> `(h) Development of standards- The Commission shall work cooperatively with public safety organizations, industry participants, and the E-911 Implementation Coordination Office to develop best practices that promote consistency, where appropriate, including procedures for--</ul>
<ul>
	<li>
<ul> `(1) defining geographic coverage areas for public safety answering points;</ul>
</li>
</ul>
<ul>
	<li>
<ul> `(2) defining network diversity requirements for delivery of IP-enabled 9-1-1 and enhanced 9-1-1 calls;</ul>
</li>
</ul>
<ul>
	<li>
<ul> `(3) call-handling in the event of call overflow or network outages;</ul>
</li>
</ul>
<ul>
	<li>
<ul> `(4) public safety answering point certification and testing requirements;</ul>
</li>
</ul>
<ul>
	<li>
<ul> `(5) validation procedures for inputting and updating location information in relevant databases; and</ul>
</li>
</ul>
<ul>
	<li>
<ul> `(6) the format for delivering address information to public safety answering points.</ul>
</li>
</ul>
<ul> `(i) Rule of Construction- Nothing in the New and Emerging Technologies 911 Improvement Act of 2008 shall be construed as altering, delaying, or otherwise limiting the ability of the Commission to enforce the Federal actions taken or rules adopted obligating an IP-enabled voice service provider to provide 9-1-1 or enhanced 9-1-1 service as of the date of enactment of the New and Emerging Technologies 911 Improvement Act of 2008.'; and</ul>
<ul>
	<li>
<ul> (3) in section 7 (as redesignated by paragraph (1) of this section) by adding at the end the following new paragraph:</ul>
</li>
</ul>
<ul>
	<li>
<ul> `(8) IP-ENABLED VOICE SERVICE- The term `IP-enabled voice service' has the meaning given the term `interconnected VoIP service' by section 9.3 of the Federal Communications Commission's regulations (47 CFR 9.3).'.</ul>
</li>
</ul>
<h3>SEC. 102. MIGRATION TO IP-ENABLED EMERGENCY NETWORK.</h3>
<ul> Section 158 of the National Telecommunications and Information Administration Organization Act (47 U.S.C. 942) is amended--</ul>
<ul>
	<li>
<ul> (1) in subsection (b)(1), by inserting before the period at the end the following: `and for migration to an IP-enabled emergency network';</ul>
</li>
</ul>
<ul>
	<li>
<ul> (2) by redesignating subsections (d) and (e) as subsections (e) and (f), respectively; and</ul>
</li>
</ul>
<ul>
	<li>
<ul> (3) by inserting after subsection (c) the following new subsection:</ul>
</li>
</ul>
<ul> `(d) Migration Plan Required-</ul>
<ul>
	<li>
<ul> `(1) NATIONAL PLAN REQUIRED- No more than 270 days after the date of enactment of the New and Emerging Technologies 911 Improvement Act of 2008, the Office shall develop and report to Congress on a national plan for migrating to a national IP-enabled emergency network capable of receiving and responding to all citizen-activated emergency communications and improving information sharing among all emergency response entities.</ul>
</li>
</ul>
<ul>
	<li>
<ul> `(2) CONTENTS OF PLAN- The plan required by paragraph (1) shall--</ul>
</li>
</ul>
<ul>
	<li>
<ul>
	<li>
<ul> `(A) outline the potential benefits of such a migration;</ul>
</li>
</ul>
</li>
</ul>
<ul>
	<li>
<ul>
	<li>
<ul> `(B) identify barriers that must be overcome and funding mechanisms to address those barriers;</ul>
</li>
</ul>
</li>
</ul>
<ul>
	<li>
<ul>
	<li>
<ul> `(C) provide specific mechanisms for ensuring the IP-enabled emergency network is available in every community and is coordinated on a local, regional, and statewide basis;</ul>
</li>
</ul>
</li>
</ul>
<ul>
	<li>
<ul>
	<li>
<ul> `(D) identify location technology for nomadic devices and for office buildings and multi-dwelling units;</ul>
</li>
</ul>
</li>
</ul>
<ul>
	<li>
<ul>
	<li>
<ul> `(E) include a proposed timetable, an outline of costs, and potential savings;</ul>
</li>
</ul>
</li>
</ul>
<ul>
	<li>
<ul>
	<li>
<ul> `(F) provide specific legislative language, if necessary, for achieving the plan;</ul>
</li>
</ul>
</li>
</ul>
<ul>
	<li>
<ul>
	<li>
<ul> `(G) provide recommendations on any legislative changes, including updating definitions, that are necessary to facilitate a national IP-enabled emergency network;</ul>
</li>
</ul>
</li>
</ul>
<ul>
	<li>
<ul>
	<li>
<ul> `(H) assess, collect, and analyze the experiences of the public safety answering points and related public safety authorities who are conducting trial deployments of IP-enabled emergency networks as of the date of enactment of the New and Emerging Technologies 911 Improvement Act of 2008;</ul>
</li>
</ul>
</li>
</ul>
<ul>
	<li>
<ul>
	<li>
<ul> `(I) identify solutions for providing 9-1-1 and enhanced 9-1-1 access to those with disabilities and needed steps to implement such solutions, including a recommended timeline; and</ul>
</li>
</ul>
</li>
</ul>
<ul>
	<li>
<ul>
	<li>
<ul> `(J) analyze efforts to provide automatic location for enhanced 9-1-1 services and provide recommendations on regulatory or legislative changes that are necessary to achieve automatic location for enhanced 9-1-1 services.</ul>
</li>
</ul>
</li>
</ul>
<ul>
	<li>
<ul> `(3) CONSULTATION- In developing the plan required by paragraph (1), the Office shall consult with representatives of the public safety community, groups representing those with disabilities, technology and telecommunications providers, IP-enabled voice service providers, Telecommunications Relay Service providers, and other emergency communications providers and others it deems appropriate.'.</ul>

</ul>
<h4>TITLE II--PARITY OF PROTECTION</h4>
<h3>SEC. 201. LIABILITY.</h3>
<ul> (a) Amendments- Section 4 of the Wireless Communications and Public Safety Act of 1999 (47 U.S.C. 615a) is amended--</ul>

<ul> (1) by striking `parity of protection for provision or use of wireless service.' in the section heading and inserting `service provider parity of protection.';</ul>

<ul> (b) Definition- Section 7 of the Wireless Communications and Public Safety Act of 1999 (as redesignated by section 101(1) of this Act) is further amended by adding at the end the following new paragraphs:</ul>
<ul>
	<li>
<ul> `(8) OTHER EMERGENCY COMMUNICATIONS SERVICE- The term `other emergency communications service' means the provision of emergency information to a public safety answering point via wire or radio communications, and may include 9-1-1 and enhanced 9-1-1 service.</ul>
</li>
</ul>
<ul>
	<li>
<ul> `(9) OTHER EMERGENCY COMMUNICATIONS SERVICE PROVIDER- The term `other emergency communications service provider' means--</ul>
</li>
</ul>
<ul>
	<li>
<ul>
	<li>
<ul> `(A) an entity other than a local exchange carrier, wireless carrier, or an IP-enabled voice service provider that is required by the Federal Communications Commission consistent with the Commission's authority under the Communications Act of 1934 to provide other emergency communications services; or</ul>
</li>
</ul>
</li>
</ul>
<ul>
	<li>
<ul>
	<li>
<ul> `(B) in the absence of a Commission requirement as described in subparagraph (A), an entity that voluntarily elects to provide other emergency communications services and is specifically authorized by the appropriate local or State 9-1-1 service governing authority to provide other emergency communications services.</ul>
</li>
</ul>
</li>
</ul>
<ul>
	<li>
<ul> `(10) ENHANCED 9-1-1 SERVICE- The term `enhanced 9-1-1 service' means the delivery of 9-1-1 calls with automatic number identification and automatic location identification, or successor or equivalent information features over the wireline E911 network (as defined in section 9.3 of the Federal Communications Commission's regulations (47 C.F.R. 9.3) as of the date of enactment of the New and Emerging Technologies 911 Improvement Act of 2008) and equivalent or successor networks and technologies. The term also includes any enhanced 9-1-1 service so designated by the Commission in its Report and Order in WC Docket Nos. 04-36 and 05-196, or any successor proceeding.'.</ul>

</ul>
<h4>TITLE III--AUTHORITY TO PROVIDE CUSTOMER INFORMATION FOR 911 PURPOSES</h4>
<h3>SEC. 301. AUTHORITY TO PROVIDE CUSTOMER INFORMATION.</h3>
<ul> Section 222 of the Communications Act of 1934 (47 U.S.C. 222) is amended--</ul>
<ul>
	<li>
<ul> (1) by inserting `or the user of an IP-enabled voice service (as such term is defined in section 7 of the Wireless Communications and Public Safety Act of 1999 (47 U.S.C. 615b))' after `section 332(d))' each place it appears in subsections (d)(4) and (f)(1);</ul>
</li>
</ul>
<ul>
	<li>
<ul> (2) by striking `Wireless' in the heading of subsection (f); and</ul>
</li>
</ul>
<ul>
	<li>
<ul> (3) in subsection (g), by inserting `or a provider of IP-enabled voice service (as such term is defined in section 7 of the Wireless Communications and Public Safety Act of 1999 (47 U.S.C. 615b))' after `telephone exchange service'.</ul>

Universal Service Reform, Accountability, and Efficiency Act of 2008 - Amends the Communications Act of 1934 to revise the policies concerning the principles for the advancement of universal service to require that the policies be based on the principles of affordability, efficiency, certain contribution and distribution requirements, transparency, consumer focus, and access to advanced telecommunications services for schools, libraries, and rural health care providers.

Requires that universal service support be used solely to provide voice (including IP-enabled voice) communications in high cost areas and to low-income households. Authorizes the FCC to select any contribution mechanism that is consistent with the above principles and that:

(1) is based exclusively on providing voice communications service;
(2) does not assess broadband transmission or Internet access services; and
(3) includes a universal service contribution low-income exemption. Requires that universal service support decline over time. Allows, after this Act's auction, only eligible telecommunications providers to receive support for service in high cost areas. Prohibits the receipt of support for services in high cost areas having a high percentage of high income households. Prohibits a state from assessing interstate services in order to fund a state's universal service program. Requires a reverse auction plan in which each auction winner has the privileges and obligations of a provider-of-last-resort to be used to distribute universal service support for voice communications service in high cost areas.

Provides for subsequent auctions, including transitioning away from subsidizing a provider-of-last-resort. Requires the FCC to:

(1) determine whether the goals of universal service are being achieved in an economically efficient way;
(2) strengthen the universal service program's oversight structure;
(3) provide the FCC's Inspector General with resources to conduct regular and thorough audits;
(4) permanently bar anyone committing universal service fraud from receiving future subsidies; and

			<content:encoded><![CDATA[Congress is trying to push through rules of the road for enhanced 911 service on Internet-protocol-enabled voice services before turning its attentions to getting re-elected.
<p class="article_text">The Senate Thursday passed by unanimous consent its version of a bill that would give cable operators and other Internet-phone-service providers the same rights of interconnection as traditional 911 service to ensure that 911 calls reach a local operator and that the operator can also determine the source of the emergency call — enhanced 911 service — as well as similar liability relief for those taking the calls. It would also call for the drawing up of a plan for a national IP-enabled emergency network for “citizen-activated” emergencies.</p>
<p class="article_text"><span id="more-149"></span></p>
<p class="article_text">The National Cable &amp; Telecommunications Association supported the bill, saying in a letter to Senate leaders in February, “When consumers dial 911 for emergency service, they should do so with confidence that their calls for help will be answered without regard to who provides their phone service or what technology they employ.” The bill, H.R. 3403, is a compromise version of a similar bill that passed in the House. But with some amendments added on the Senate side, it now has to go back to the House for its approval, which is expected, various senators and staffers said.</p>
<p class="article_text">Senate Commerce Committee chairman Daniel Inouye (D-Hawaii) said they have been working with House members and that the bill should pass quickly. “We expect the House to act expeditiously so that this bill can become law,” he added, “allowing our 911 system to continue to save lives and ensuring that individuals can always call for help regardless of the underlying technology they use.”</p>
<p class="article_text">The Federal Communications Commission paved the way for e911 service in 2005 with mandates that voice-over-IP providers deliver 911 service that linked to local operators after hearing from a parade of witnesses who talked of children dying and family members put at risk after calls to VoIP e911 services that did not do so.</p>

<span class="article_text">The House, in an overwhelming bipartisan vote, yesterday approved a sweeping new surveillance law that extends the government’s eavesdropping capability and effectively would shield telecommunications companies from lawsuits for cooperating with the Bush administration’s warrantless wiretapping program.</span>

<span class="article_text">Ending a year-long battle with President Bush, the House passed, by a 293 to 129 vote, an overhaul of the 1978 Foreign Intelligence Surveillance Act (FISA). The bill provides a legal avenue for AT&amp;T, Verizon Communications and other telecommunications firms to ward off about 40 lawsuits alleging that they violated customers’ privacy by helping the government conduct a warrantless spying program after the Sept. 11, 2001, attacks. </span>

<span class="article_text">Before the vote, Bush said the plan, which is expected to clear the Senate next week, would help thwart new terrorist attacks. “It’s vital that our intelligence community has the ability to learn who the terrorists are talking to, what they’re saying and what they are planning,” he said. </span>

<span class="article_text">Only one Republican opposed the bill, but Democrats were sharply divided. And the legislation presented a fresh foreign policy dilemma for Sen. Barack Obama (D-Ill.). The party’s presumptive presidential nominee announced his support of the FISA bill despite active opposition to it from the liberal activist base that has financially fueled his campaign. “Given the legitimate threats we face, providing effective intelligence collection tools with appropriate safeguards is too important to delay. So I support the compromise, but do so with a firm pledge that as President, I will carefully monitor the program,” </span>

<span class="article_text">Obama said in a statement. Obama had previously opposed a different Senate version, which passed on Feb. 12, because it gave “blanket immunity” to the telecommunications companies, according to a statement issued at the time.</span>

<span class="article_text">Sen. John McCain (Ariz.), the presumptive Republican presidential nominee, supports the FISA legislation.</span>

<span class="article_text">Democrats have resisted passing a new FISA law since last summer and implemented a temporary act that expired in August. They demanded more information about the warrantless wiretapping program that the administration pursued for years after the terrorist attacks. But after four months of negotiations, the bill gives intelligence agencies most of what they had been seeking.</span>

<span class="article_text">The agreement gives telecom companies the ability to have privacy lawsuits thrown out if they demonstrate to a federal judge that they received written assurance from the Bush administration that the spying was legal. House GOP leaders and opponents of the legislation consider the new court review a formality that will lead to dismissal of the suits. </span>

<span class="article_text">The bill requires approval by the secret FISA court of procedures for intercepting foreigners’ e-mails and telephone calls. Spying on U.S. citizens, including those overseas, would require individual warrants from the same court.</span>

House Speaker Nancy Pelosi (D-Calif.) said she supported the bill primarily because it rejects Bush’s argument that a wartime chief executive has the “inherent authority” to conduct some surveillance activity he considers necessary to fight terrorism. <p class="article_paragraphs">The Show Me State must allow VoIP technology to develop and flourish throughout the state without regulatory interference, said the Institute for Policy Innovation in testimony to the Missouri legislature today.</p>
<p class="article_paragraphs">VoIP is a compelling application which will encourage economic advancement, job creation and income growth as it is a "better, cheaper, and faster" vehicle for voice communications. "These sorts of technology innovations are the prime drivers of economic growth because they increase productivity of businesses and enterprises large and small," said IPI President Tom Giovanetti.</p>
<p class="article_paragraphs"><span id="more-40"></span></p>
<p class="article_paragraphs">Missouri must resist the urge to regulate. The Missouri Public Utilities Commission is showing a strong inclination toward regulation of the VoIP market, and throughout the recent report from the VoIP Task Force, the Commission expresses distrust in markets and competition. "Missouri must show bold leadership, not by being the first state to attempt to tax and regulate an exciting new technology, but rather by reining in the regulators," said Giovanetti.</p>
<p class="article_paragraphs">It is vital to prevent discriminatory treatment of any technology or application. Legislators should not choose winners or losers in the communications sector. It makes no sense to tax the risk-taking companies who are creating jobs by investing and building out infrastructure in Missouri. "We ought to be praising and rewarding the facilities-based providers who are doing the favor of building out a critical broadband infrastructure using their own risk capital," said Bartlett Cleland, Director of the IPI Center for Technology Freedom.</p>
<p class="article_paragraphs">Those who feed from the public trough are the same ones advocating regulation and taxation. Many of the smaller and rural telecom providers that support regulation and taxation of VoIP are also the companies whose entire business models are dependent upon being recipients of public subsidies in the form of universal service fees. These companies already receive public assistance, and are trying to slow their competitors' adoption of exciting technology by loading it with new taxation and regulation.</p>
<p class="article_paragraphs">A disproportionate tax burden already weighs upon communications. The only industries that bear a heavier tax burden are cigarettes and alcohol. Communications consumers' final bills are often a whopping 40 to 50% taxes and fees. "These are dishonest, hidden taxes," said Cleland, "It makes no sense for one of our most critical industries to be bearing such an inordinate tax burden."</p>
<p class="article_paragraphs">If Missouri wants to be competitive in the communications market and to entice new and technologically advanced infrastructure, the state should relax regulation rather than increase it. The goal of this new law is to let anyone enter any communications business -- to let any communications business compete in any market against any other.<span id="more-710"></span>

The Telecommunications Act of 1996 has the potential to change the way we work, live and learn.  It will affect telephone service -- local and long distance, cable programming and other video services, broadcast services and services provided to schools.

The Federal Communications Commission has a tremendous role to play in creating fair rules for this new era of competition.  At this Internet site, we will provide information about the FCC's role in implementing this new law, how you can get involved and how these changes might impact you.

This page will include information listing the proceedings the FCC will complete to open up local phone markets, increase competition in long distance and other steps.  You will find copies of news releases summarizing action, announcements of meetings where these items will be discussed, and charts describing the work ahead of us and where (within the FCC) and when it will be completed.  <strong>Please note:</strong> some of the links on this page lead to resources outside the FCC.  The presence of these links  should not be taken as an endorsement by the FCC of these sites or their content.
